Directorate of Criminal InvestigaI) and the Director of Public Prosecutions (DPP) want five suspects charged with the murder of Dr Victoria Nthunya Mutiso to be denied bail.<\/p>\n\n\n\n
In an affidavit filed in court, Homicide Investigations Bureau officer CPL Romana Odour says there are compelling reasons to keep the suspects in custody, including fears of witness interference, destruction of evidence, collusion and flight risk.<\/p>\n\n\n\n
The five are jointly charged with other suspects who are yet to be arraigned over the killing of Dr Mutiso on July 29, 2026.<\/p>\n\n\n\n
While acknowledging the right to bail under Article 49(1)(h) of the Constitution, the investigating officer argues that detention is necessary as investigations continue.<\/p>\n\n\n\n
According to the affidavit, investigators link the murder to a long-running dispute over a 20-acre parcel of land in Mlolongo involving Dr Mutiso, her husband and the first, second and third accused persons.<\/p>\n\n\n\n
The officer alleges that Rose Mbithe Mulwa, Angela Mulwa and Chris Mulwa knew the deceased and her family and were part of a wider group that allegedly planned and facilitated the killing.<\/p>\n\n\n\n
The DCI alleges the group spent about four months monitoring Dr Mutiso, gathering information on her and her family, and organizing communication and transport ahead of the attack. Telephone and other electronic records allegedly place the suspects in meetings and communications linked to the plan.*<\/p>\n\n\n\n
The affidavit cites an earlier incident on July 7, 2026, when Dr Mutiso reported to police that two armed people on a motorcycle confronted her near Junction Mall along Ngong Road. Investigators allege the fourth accused was the pillion passenger in that incident.<\/p>\n\n\n\n
On July 29, Dr Mutiso was allegedly intercepted while travelling in an Uber, registration number KDJ 609D, and shot dead.<\/p>\n\n\n\n
Following the arrests, police conducted searches and recovered items they consider crucial to the case.<\/p>\n\n\n\n
At the Karen residence of the first and second accused, police allegedly found a black and red A7 notebook containing details of the Uber vehicle used by Dr Mutiso, Airtel SIM cards, photographs of the deceased and her family members, and copies of her husband’s national ID card.<\/p>\n\n\n\n
A search at the Kerarapon home of the third accused allegedly led to the recovery of a vehicle said to have been taken from the deceased’s home in Mlolongo.<\/p>\n\n\n\n
The fourth accused, Elijah Kimoi, is described as a serving police officer at the time of the alleged offence. Investigators accuse him of firing the fatal shot and allege he fled after the killing before being arrested 10 days later.<\/p>\n\n\n\n
The DCI further alleges that Kimoi burned the clothes he wore during the shooting in an attempt to destroy forensic evidence<\/p>\n\n\n\n
The prosecution also raises concerns over alleged attempts to interfere with people cooperating with investigators.<\/p>\n\n\n\n
According to Odour, investigators received intelligence on August 20 about an alleged plan to harm suspects who had agreed to assist with investigations.<\/p>\n\n\n\n
The fifth accused, Maritim Kimutai, was arrested at Pangani Police Station on August 22 while allegedly visiting one of the cooperating suspects and carrying food.<\/p>\n\n\n\n
The DCI says information from Kimutai’s phone helped trace and arrest more suspects, including three who had allegedly escaped to Uganda.<\/p>\n\n\n\n
Investigations are still ongoing, with several alleged accomplices still at large, including some senior police officers, the officer said.<\/p>\n\n\n\n
The prosecution argues that releasing the five could allow them to approach witnesses directly or through associates, destroy or hide evidence, and interfere with investigations.<\/p>\n\n\n\n
Dr Mutiso’s husband has been identified as a key prosecution witness and is considered vulnerable due to his relationship with the first three accused and the trauma linked to his wife’s death.<\/p>\n\n\n\n
The DCI says some witnesses have been placed under the Witness Protection Agency, raising fears they could be contacted or influenced if the suspects are released.<\/p>\n\n\n\n
The case has also been linked to a separate inquiry into alleged destruction and loss of property belonging to Dr Mutiso and her husband in Mlolongo, valued at about Sh37 million, alongside an alleged forged title deed.<\/p>\n\n\n\n
The investigating officer maintains that ordinary bail conditions would not mitigate the risks, arguing the alleged network includes people still at large and individuals with access to police resources.<\/p>\n\n\n\n
The DCI and DPP are therefore asking the court to keep the five in custody to protect witnesses, preserve evidence and allow investigations to continue.<\/p>\n\n\n\n
